Terms of Service

1. Acceptance

By using the Service you confirm that you can form a binding contract, that you will comply with these Terms, and that you will comply with the Discord Terms of Service and Community Guidelines. Server administrators who add the Bot agree to these Terms on behalf of their server.

2. The Service

Perc Bot is an all-in-one Discord community management application offering support tickets, verification and security, invite tracking, moderation and AutoMod, leveling and rewards, giveaways, a product showcase/storefront, and related tools, along with a web control panel for configuration. Features may be added, changed, or removed over time.

3. Eligibility

You must meet Discord’s minimum age requirement (at least 13, or older where required by your country) and be permitted to use Discord in your jurisdiction. You are responsible for all activity under your Discord account and, where applicable, your panel account.

4. Licenses & keys

• Grant. Subject to these Terms and payment of any applicable fees, you are granted a limited, non-exclusive, non-transferable, revocable license to use Perc Bot for the server(s) covered by your license key(s).
• One server per key. Unless stated otherwise at purchase, each license key activates the Service for a single Discord server. You may link additional servers by obtaining additional keys. A single account may hold multiple keys and manage its linked servers from the control panel.
• No resale or redistribution. You may not resell, sublicense, redistribute, rent, or share license keys, or copy, decompile, or redistribute the Bot’s code, except under a separate written reseller or partner agreement with the operator.
• Revocation. The operator may suspend or revoke a license for breach of these Terms, chargebacks or fraud, abuse of the Service, or as required by law.

5. Acceptable use

You agree not to, and not to allow others to:

• Use the Service to violate the Discord Terms of Service, Community Guidelines, or any applicable law or regulation.
• Use the Service to harass, abuse, defraud, or harm others, to distribute malware, or to facilitate unauthorized access to any system or account.
• Interfere with, overload, or attempt to disrupt the Service or its infrastructure, or circumvent any access, rate, or security controls.
• Attempt to reverse engineer, scrape, or extract the Bot’s source code or data except as permitted by law.
• Misrepresent your identity or impersonate the operator, Discord, or any other party.

You are solely responsible for how you configure and operate the Bot within your server, including moderation decisions, content you post through it, and compliance with laws applicable to your community and products.

6. Payments & refunds

• Purchases. License keys and any paid features are sold through our checkout provider (SellAuth) or other authorized channels. Prices and what each purchase includes are shown at the time of purchase.
• Refunds. Because license keys grant immediate access to digital goods, all sales are final and non-refundable except where required by law or expressly stated at purchase. If you believe a charge is in error, contact us before initiating a chargeback.
• Chargebacks. Initiating a chargeback or payment dispute may result in immediate suspension or revocation of your licenses and access.

7. Rewards, chips & boosts

• Chips and in-server currency are for entertainment only, have no monetary value, cannot be purchased for cash, and cannot be redeemed for cash. They may be reset, adjusted, or removed at any time.
• Payouts and reward balances configured by a server administrator are managed by that administrator; the operator is not responsible for rewards, payouts, or boosts promised or administered by individual servers.
• Social boosts requested through the Bot are fulfilled by a third-party SMM provider and are subject to that provider’s availability and terms. Delivery times and outcomes are not guaranteed by the operator.

8. Third-party services

The Service integrates with third parties including Discord, our hosting provider, SellAuth, email delivery, and SMM providers. Your use of those services is governed by their own terms and privacy policies. The operator is not responsible for third-party services or their acts or omissions.

9. Availability & “as is”

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The operator does not warrant that the service will be uninterrupted, error-free, secure, or that it will meet your requirements. You use the service at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, the operator and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the service. To the maximum extent permitted by law, the operator’s total liability for any claim relating to the service shall not exceed the greater of the amount you paid for the service in the three (3) months before the claim, or twenty U.S. dollars (US$20).

11. Suspension & termination

You may stop using the Service at any time by removing the Bot from your server. The operator may suspend or terminate your access to the Service, in whole or in part, with or without notice, for any breach of these Terms, suspected fraud or abuse, legal requirements, or risk to the Service or other users. Sections that by their nature should survive termination (including licenses restrictions, disclaimers, limitation of liability, and governing law) will survive.

12. Changes to the Service and Terms

We may modify the Service or these Terms at any time. Material changes to these Terms will be reflected by updating the “Last updated” date above and, where appropriate, by notice through the Bot or our support channels. Your continued use after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there for any dispute not subject to arbitration or small-claims resolution, to the extent permitted by law.
